This notice explains how Fluenx processes personal data collected through this website, under Articles 13 and 14 of Regulation (EU) 2016/679 ("GDPR").

Two layers of processing

Fluenx is the data controller for the data of its own registered users (email, hashed password, application logs, product analytics).

Fluenx acts as a data processor (Art. 28 GDPR) for the leads collected by forms created by its users. For this data, the controller is the Fluenx customer who built the form and accepted the DPA at signup. The DPA text is available at /legal/dpa.

1. Data controller

The data controller is Studio Digitale, registered at Via La Farina 21, 98077 Santo Stefano di Camastra (ME), Italia (P.IVA 03704400831).

2. Data processed and purposes

We only collect contact data (name, email, phone) and the answers to the questions the user voluntarily fills in on the form. Processing purposes are:

  • responding to the user's request and contacting them about the service of interest (legal basis: Art. 6(1)(b) GDPR — pre-contractual measures);
  • complying with legal obligations (Art. 6(1)(c));
  • subject to separate, specific consent, sending commercial communications and newsletters (Art. 6(1)(a) GDPR).

We do not collect health data or special categories of data within the meaning of Art. 9 GDPR.

3. Providing data and consequences of refusal

Providing contact data and consent to processing is necessary to submit the request. Refusal prevents form submission but has no further consequences. Consent to marketing is optional and can be withdrawn at any time.

4. Recipients and external processors

Data may be disclosed to third parties providing technical services (hosting, email, analytics, CRM integration), appointed as data processors under Art. 28 GDPR.

5. Transfers outside the EU

Some providers may transfer data to third countries on the basis of the EU-US Data Privacy Framework or Standard Contractual Clauses (SCCs) adopted by the European Commission, supplemented by additional measures where necessary.

6. Retention period

Data is retained for the time needed to handle the request and, where applicable, for the period required by tax and accounting regulations (usually up to 10 years). Data processed for marketing purposes is retained until consent is withdrawn and in any case no longer than 24 months from the last interaction.

7. Data subject rights

Under Articles 15-22 GDPR the user may exercise the rights of access, rectification, erasure, restriction, portability, objection and withdrawal of consent. A request can be submitted using the online request form or by writing to studiodigitaleconsulting@gmail.com. A complaint can also be lodged with the competent data protection supervisory authority.
